Understanding DUI Law in Florida
Florida Statute §316.193 defines DUI as either:
-
Operating a motor vehicle with a blood alcohol content (BAC) of 0.08% or higher, OR
-
Driving while your normal faculties are impaired due to alcohol, controlled substances, or both.
You can also be charged even if you’re not actively driving—as long as you’re in “actual physical control” of the vehicle, such as being behind the wheel with the engine running.
Aggravating factors—including high BAC (0.15%+), prior DUI convictions, causing injury, or having a child in the car—can enhance the charge and lead to felony DUI penalties.

How We Fight DUI Charges in Palm Beach County
We don’t take anything for granted—every piece of evidence is challenged, every procedure examined. Our DUI defense strategy includes:
🔍 Challenging the Stop – Did police have reasonable suspicion or probable cause?
🧪 Examining Test Results – We evaluate the breathalyzer calibration, officer certifications, and blood draw protocols.
🚨 Scrutinizing Procedures – Were your rights violated? Were you properly advised of implied consent and Miranda warnings?
📑 Pretrial Motions – Motions to suppress evidence or dismiss the charges altogether.
⚖️ Negotiating Alternative Sentencing – Diversion programs, probation, or reductions to non-DUI charges when possible.
🧑⚖️ Taking the Fight to Trial – When necessary, we present a powerful defense in court with expert witnesses and cross-examination.
